These Terms of Service ("Terms") govern your use of apps and services provided by Daily Magic, LLC ("Daily Magic", "we", "our", or "us"). By downloading, accessing, or using any of our apps, you agree to these Terms.
1. Acceptance of Terms
By using our apps, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our apps.
Some of our apps offer premium features through paid subscriptions. By subscribing:
You authorize recurring charges to your payment method through Apple or Google
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
You can manage or cancel subscriptions through your device's App Store settings
Refunds are handled by Apple or Google according to their policies
We reserve the right to change subscription pricing with notice
Free trials, if offered, automatically convert to paid subscriptions unless canceled before the trial ends.
You retain ownership of content you create in our apps (such as journal entries or questions). By using our apps, you grant us a limited license to process this content as needed to provide our services, including through third-party AI providers.
You agree not to submit content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
Some of our apps include AI-powered features such as personalized insights, Q&A, or audio generation. You acknowledge that:
AI responses are generated by third-party services and may not always be accurate
AI features are for informational and inspirational purposes only
AI features do not constitute professional advice (medical, legal, financial, therapeutic, or otherwise)
You should consult qualified professionals for professional guidance
You agree not to:
Use our apps for any unlawful purpose
Attempt to gain unauthorized access to our systems
Interfere with or disrupt our services
Reverse engineer or attempt to extract source code
Use our apps to harm, harass, or abuse others
Misuse AI features to generate harmful or inappropriate content
All content, features, and functionality of our apps (excluding user content) are owned by Daily Magic and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.
OUR APPS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR APPS WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
CONTENT PROVIDED THROUGH OUR APPS, INCLUDING AI-GENERATED CONTENT, IS FOR INFORMATIONAL AND INSPIRATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE PROFESSIONAL ADVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAILY MAGIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR APPS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Daily Magic and its officers, employees, and agents from any claims, damages, or expenses arising from your use of our apps or violation of these Terms.
Some features require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate information and to update it as needed.
You must be at least 13 years old to use our apps. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.

We may suspend or terminate your access to our apps at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the apps ceases immediately.
We may modify these Terms at any time. Continued use of our apps after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Arizona.
